The short version
- Flare alerts the people you choose. It does not call emergency services, and it can't promise anyone will see or answer an alert.
- Only add people who know you're adding them, and only share your location with people you've chosen.
- Don't send false alerts, and don't use Flare to watch or follow someone who hasn't agreed.
- You can delete your account in the app at any time.
Agreeing to these terms
These terms are between you and Emberline Industries Inc. ("we", "us") and cover the Flare and Flare Companion apps and the services behind them. By creating an account or using Flare, you agree to them and to our privacy policy. If you don't agree, please don't use Flare.
What Flare is, and what it isn't
- Flare sends alerts to the contacts you choose: an I Feel Unsafe alert to your Check-in Circle, an SOS to your emergency contacts, and a missed check-in alert if you miss a Plan.
- Flare does not contact emergency services. In an emergency, call 911 or your local emergency number.
- An alert only helps if it's delivered and someone sees it. Delivery depends on your phone, its battery, signal, location and notification settings, and on your contacts' phones. We can't guarantee that an alert will be sent, received, or answered, or that anyone will be able to help.
- Flare is an extra layer of safety, not a replacement for taking care of yourself or for professional help.
Your account
- You sign in with your phone number, using a code we text you. Keep your phone secure, and tell us if you think someone else has got into your account.
- Give us accurate information, and keep your name, number and contacts up to date. An alert sent to an old or wrong number may reach the wrong person or nobody.
- [Minimum age, and how younger users are handled, to be decided.]
Your contacts
- When you add a contact, we send them an invitation. They get none of your alerts unless they accept, and they can leave at any time. You'll see whether they've accepted.
- Only add people you have a real relationship with and who would expect to hear from you. You're responsible for the numbers you enter.
- If you're someone's contact, you agree to treat what you receive as confidential, and to use it only to help that person. Anyone on an alert can share its record, for example with police.
Text messages
Flare sends text messages (SMS) only to people who have asked for them: sign-in and confirmation codes to the account holder, and invitations, alerts and notices to contacts after a Flare user adds them. There's no marketing and no regular schedule; how often you get texts depends on how often codes are requested or alerts are sent. Message and data rates may apply. Reply STOP to stop receiving texts or HELP for help. The text messages section and the privacy policy explain more.
Using Flare properly
Please don't:
- send an alert you know is false, or use Flare to frighten or harass someone. Practice Mode is there to test your setup; it's clearly marked as practice;
- track, follow or monitor anyone who hasn't agreed to it, or add someone's number without their knowledge;
- break the law with Flare, or try to break, overload or get around the service;
- use another person's phone number or account.
We may suspend or close an account that does these things. [How we'll tell you, and how you can respond, to be decided.]
Alerts are a permanent record
SOS, I Feel Unsafe and Missed Check-In alerts, and the notes on them, are kept permanently as a record of what happened for you and the people who responded. They can't be edited or deleted, even if you delete your account. The privacy policy explains exactly what's deleted and what's kept.
Ending your use of Flare
You can delete your account in the app at any time (More, then Privacy & Sharing, then Delete account). You can't delete it during an active alert or Plan. We may change or stop parts of the service; if that affects safety features you rely on, we'll tell you in the app first where we can.
Warranties and liability
[Disclaimer of warranties and limit of liability, to be written during legal review. Because this is a safety service, the wording needs particular care.]
Governing law
[Which law governs these terms and where disputes are heard, likely Alberta, Canada, to be confirmed during legal review.]
Changes
If we change these terms, we'll update the date at the top, and tell you in the app if the change is significant.
